Correspondence looking for answers to 16th Amendment questions.

This thread of letters started with an e-mail I submitted to my congressman,
Richard Pombo, through his website at the end of February 2002. The e-mail I submitted
was my expression of outrage that the IRS and DOJ reneged on their commitment
to attend the "Truth in Taxation" event on February 27th and 28th, 2002.
- April 2, 2002 - Letter from Congressman Pombo
to Gerald Klaas confirming receipt of request.
- May 23, 2002 - First letter
from the IRS to Gerald Klaas
- June 24, 2002 - Open letter to Floyd L. Williams - Paraphrase: "Nice dance, you didn't answer the question."
- July 29, 2002 - IRS response to my letter of June 24 - Paraphrase: "I don't owe you no stinking answer."
- August 19, 2002 - Freedom of Information Act request - Sent to both IRS and DOJ
- October 24, 2002 - My response back to Floyd L. Williams - copy to Congressman Pombo and Congressman Matsui
- November 13, 2002 - Letter from DOJ to Roscoe Bartlett - DOJ response to FOIA request.
- December 18, 2002 - Floyd Williams (IRS) to Gerald Klaas - Again totally ignoring
my question and FOIA request.
- December 19, 2002 - Gerald Klaas to IRS FOIA Director - Asking status of prior FOIA request. Note
there is a statutory requirement for them to respond within 20 business days. This letter was
sent Certified Mail (tracking number 7002 2410 0003 5012 3088)
- January 8, 2003 - Amazingly, (or maybe not so amazingly) the letter sent 12/19/2002 is untrackable on the USPS website Certified Mail
tracking application. So I have
now sent three copies of the same FOIA request (plus two to Congressmen on 10/24/2002) and all
are being ignored. Today I sent yet another copy, again by Certified Mail.
- original to FOIA office 8/19/2002 (no confirmation or response ever received)
- copy direct to Floyd Williams attached to letter of 10/24/2002 (confirmed received by his letter
of 12/18/2002)
- follow-up request sent Certified Mail 12/19/2002 (lost in the mail?)
- January 9, 2003 - Letter to Congressman Ose - copies to President Bush, Senators Boxer and
Feinstein, Congressmen Pombo and Matsui, Floyd Williams (IRS), and the Sacramento Bee
- January 23, 2003 - Tally sheet FOIA Request - As Floyd Williams has totally ignored my request
to support the statement in the IRS document The Truth About Frivolous Tax Arguments which
states "enough states ratifying... even without Ohio". This FOIA requests documentation to support the claim.
- March 27, 2003 - Tally sheet FOIA Denial - The IRS determines that my letter:
- Does not adequately describe the documents requested
- Challenges the authority of the IRS
- FOIA doesn't require agencies to respond to interrogatories
- Is not a vehicle to challenge legal requirements
- January 28, 2003 - Letter to Thomas Marusin - FOIA officer, FAXed on 1/28/2003, requesting appeal of
constructive denial of prior FOIA requests. Followed with phone call on February 14, 2003.
No responsse received.
- May 4, 2003 - Letter to Congressman Ose's office - (Terri Brewster), including the letter from
DOJ to Congressman Bartlett. Explained the IRS deception of me, Congressman Ose and Congressman Pombo.
